Terms of Service

Please read these terms carefully before using Psalmix. By using our service, you agree to these terms.

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and MMC Media LLC, doing business as Psalmix ("Psalmix," "we," "us," or "our").

Welcome to Psalmix! These Terms govern your access to and use of the Psalmix mobile application, website, and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

Acceptance Mechanism: By creating an account, you agree to these Terms. We record your acceptance, including the date and time, when your account is created. If you do not agree, do not create an account or use the service.

2. Eligibility & Minimum Age

2.1 Minimum Age

Psalmix is intended for users 13 years of age or older. By creating an account, you represent that you are at least 13 years old. If you are between 13 and 18, you represent that you have your parent or guardian's permission to use the service. We do not permit users under 13 to create accounts.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3. Account Types and Subscriptions

3.1 Premium Subscription

Current subscription plans, prices, billing periods, and any free-trial terms are presented on our pricing page and at checkout before you subscribe. The price and renewal terms disclosed to you at checkout are the terms that apply to your subscription.

  • Features: Unlimited streaming, offline playback, no ads, family profiles with parental controls

3.2 Billing and Renewal

Subscriptions automatically renew each month unless canceled before the renewal date. You authorize us to charge your payment method on file for the subscription fee.

3.3 AUTO-RENEWAL DISCLOSURE

Your subscription automatically renews at the end of each billing period at the then-current rate, and the payment method on file will be charged, until you cancel. You can cancel at any time through your account settings or by emailing hello@psalmix.com; cancellation takes effect at the end of the current billing period. Subscriptions purchased through the Apple App Store or Google Play must be canceled through that store at least 24 hours before the renewal date.

This disclosure is presented to you before completing your purchase on the subscription/checkout page. You may cancel at any time through your account settings at psalmix.com/settings or by emailing hello@psalmix.com. Cancellation takes effect at the end of the current billing period.

3.4 Family Plan

Family Plan subscriptions allow up to 6 accounts for members of the same household. All family plan members must be 13 years of age or older. The primary account holder is responsible for all activity under the family plan.

4. Free Trials

  • Free-trial availability, length, and whether a payment method is required are stated at signup or checkout before your trial begins
  • Free trials are available once per user/household
  • If your trial requires a payment method, you will be charged when the trial ends unless you cancel first; the amount and date of the first charge are disclosed before you start the trial
  • If your trial does not require a payment method, you will not be charged; to continue using the Service after the trial you must select a plan
  • Cancel anytime during the trial period without charge

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings at psalmix.com/settings or by contacting support. Cancellation takes effect at the end of your current billing period.

5.2 Refund Policy

Refunds: Monthly subscriptions: you may request a full refund within 24 hours of your initial purchase or renewal by contacting hello@psalmix.com. Annual subscriptions: you may request a pro-rated refund within 7 days of purchase. If you experience a service outage affecting your ability to use Psalmix for more than 48 consecutive hours, you may request a credit by contacting hello@psalmix.com. Refund requests must be submitted to hello@psalmix.com with your account email and reason.

  • If you cancel, you retain access until the end of your paid period
  • Free trial cancellations result in immediate loss of access

6. Acceptable Use

6.1 Permitted Use

You may use the Service for personal, non-commercial purposes to:

  • Stream and download music for offline listening
  • Create and share playlists
  • Discover new values-aligned music

6.2 Prohibited Activities

You agree NOT to:

  • Share your account credentials with others
  • Circumvent content protection or authentication measures
  • Download or redistribute music outside the app
  • Use the Service for commercial purposes without authorization
  • Attempt to reverse engineer, decompile, or hack the Service
  • Upload malicious content or spam
  • Impersonate others or create fake accounts
  • Harass, abuse, or harm other users

7. Content and Intellectual Property

7.1 Our Content

All music, artwork, text, software, and other content on Psalmix ("Content") is owned by Psalmix or our licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Content solely through the Service for personal, non-commercial use. This license terminates if you violate these Terms.

7.3 User Content

By creating playlists or sharing content on Psalmix, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the Service.

8. Parental Controls and Responsibilities

8.1 Parent/Guardian Obligations

If you create a family account, you agree to:

  • Supervise your children's use of the Service
  • Set appropriate content maturity levels
  • Review and manage parental control settings
  • Be responsible for your children's activities on the Service

8.2 Content Filtering

While Psalmix provides age-appropriate content filtering, parents are ultimately responsible for monitoring their children's media consumption.

9. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Please review it carefully.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We may modify, suspend, or discontinue the Service at any time.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSALMIX (MMC MEDIA LLC) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Consumer Protection Carve-Out: Nothing in this limitation of liability excludes or limits liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded under applicable consumer protection law.

11. Indemnification

You agree to indemnify and hold Psalmix (MMC Media LLC), its officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use or misuse of the Service

Minor Exemption: Users under 18 years of age are not subject to this indemnification obligation to the extent prohibited by applicable law.

12. Termination

12.1 By You

You may terminate your account at any time by canceling your subscription and deleting your account through the app settings.

12.2 By Us

We may suspend or terminate your account for violation of these Terms, non-payment, or illegal activity. For non-urgent violations, we will provide notice and an opportunity to cure where reasonable.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data in accordance with our Privacy Policy.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to contact us at hello@psalmix.com to attempt informal resolution.

13.2 Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the JAMS Streamlined Arbitration Rules and the JAMS Consumer Arbitration Minimum Standards. You waive your right to a jury trial and to participate in class actions. Your share of arbitration filing fees will not exceed $250; we will pay all other JAMS fees and costs as required by the JAMS Consumer Minimum Standards. Any arbitration hearing may be conducted remotely (by video) or in the county where you reside, at your election. You may opt out of this arbitration agreement by emailing hello@psalmix.com with subject line 'Arbitration Opt-Out' within 30 days of the date you first created your Psalmix account. Opting out does not affect your right to use the service. Either party may bring an individual claim in small claims court.

Coordinated Filings: If 25 or more substantially similar arbitration demands are brought against Psalmix by the same or coordinated counsel, the parties agree that the demands will be resolved in staged proceedings: bellwether arbitrations of up to 10 demands per stage will proceed first, and the remaining demands will not be filed (and no fees will be due on them) until the prior stage concludes. Statutes of limitation are tolled while a demand awaits its stage.

13.3 Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Disputes not subject to arbitration shall be brought in state or federal courts located in Utah.

13.4 Minor Carve-Out

Users who are minors (under 18) are not bound by the arbitration agreement or indemnification provisions to the extent prohibited by applicable law.

14. DMCA / Copyright Infringement

Psalmix respects intellectual property rights. If you believe content on our service infringes your copyright, please send a written notice to hello@psalmix.com including:

  1. Identification of the copyrighted work claimed to be infringed
  2. Identification of the allegedly infringing material and its location
  3. Your contact information
  4. A statement of good faith belief that the use is not authorized
  5. A statement, under penalty of perjury, that the information is accurate and you are authorized to act

15. Changes to Terms

We may modify these Terms from time to time. For material changes, we will provide at least 30 days' advance notice before the updated Terms take effect, by:

  • Posting updated Terms with a new "Last Updated" date
  • Sending email notification
  • In-app notification

Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you don't agree to the new Terms, you must stop using the Service.

16. Apple App Store Additional Terms

If you access the Service through an app downloaded from the Apple App Store, the following additional terms apply:

  • These Terms are an agreement between you and MMC Media LLC only — not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • Your license to the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the App Store Terms of Service (except that the app may be accessed by other household accounts via Family Sharing).
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
  • If a third party claims the app infringes its intellectual-property rights, MMC Media LLC — not Apple — is responsible for the investigation, defense, settlement, and discharge of that claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Questions, complaints, and claims regarding the app should be directed to MMC Media LLC at hello@psalmix.com.
  • You must comply with applicable third-party terms of agreement (for example, your wireless data service agreement) when using the app.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Psalmix.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
