Copyright protection and DMCA compliance procedures

1. Copyright Ownership

Psalmix is operated by MMC Media LLC. Psalmix respects the intellectual property rights of others and expects our users to do the same. All music content available on the Psalmix platform is either:

  • Licensed to Psalmix: Content we have obtained proper licenses and permissions to distribute
  • AI-Assisted Content: Some music on Psalmix is created using AI music generation tools under license. Psalmix has obtained the right to use, distribute, and stream this content through our platform. Questions about specific content may be directed to hello@psalmix.com with subject 'Licensing Inquiry'.

The music catalog on Psalmix is proprietary and exclusive to our service. All recordings, compositions, artwork, and accompanying materials are protected by United States and international copyright laws.

2. DMCA Compliance

Psalmix complies with the Digital Millennium Copyright Act of 1998 (DMCA) and responds promptly to valid copyright infringement notices. We take copyright infringement seriously and will investigate all claims in accordance with the DMCA.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our service, please notify our DMCA Agent as described below.

3. How to File a DMCA Notice

To file a notice of copyright infringement with us, you must provide a written communication that includes the following information, as required by the DMCA:

Required Elements:

  1. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works
  3. Location of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (e.g., specific URL, song title, artist name, or album name on Psalmix)
  4. Contact Information: Your name, address, telephone number, and email address
  5. Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

Subject: DMCA Notice

Registration Status: MMC Media LLC's designated DMCA agent registration with the U.S. Copyright Office is pending. Once registered, agent information will be available at copyright.gov/dmca-directory. A registered agent address will be added upon completion of Copyright Office registration.

We recommend sending notices via email for fastest processing. Please include "DMCA Notice" in the subject line.

5. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent. Your counter-notification must be sent to hello@psalmix.com with subject 'DMCA Counter-Notice' and must include the following:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. Consent to jurisdiction of the Federal District Court for the district in which your address is located (or the Northern District of Utah if you are outside the US)
  6. Consent to accept service of process from the original complainant or their agent

Upon receipt of a valid counter-notification, we will forward it to the original complaining party within 5 business days. If we do not receive notice within 10 business days that the complaining party is seeking a court order to prevent further infringement, we may restore the removed material. You may be subject to liability if you misrepresent that material was removed by mistake or misidentification (17 U.S.C. § 512(g)(3)).

6. Repeat Infringer Policy

To comply with the DMCA, Psalmix has adopted the following policy regarding repeat infringers:

Definition: A "repeat infringer" is a user who has been found to have submitted two (2) or more valid DMCA infringement notices within any 12-month period, or who is otherwise determined to be a repeat infringer of intellectual property rights. "Valid" means the notice was not retracted and no successful counter-notification was filed.

Enforcement: Upon identification of a repeat infringer, Psalmix will terminate the user's account permanently. The account holder loses all access to the service and their saved content, and no refund will be issued for remaining subscription time.

Psalmix also reserves the right to terminate accounts of any users who engage in flagrant willful infringement of intellectual property rights, even if they do not meet the definition of "repeat infringer" above.

7. Scope of This Policy

This DMCA policy applies to content uploaded or shared by users (such as playlist names, descriptions, and profile information). The music catalog on Psalmix is licensed or created by our team. Copyright claims regarding catalog music should be directed to hello@psalmix.com with subject 'Licensing Inquiry' for direct resolution.

8. User Content and Playlists

While all music content on Psalmix is owned or licensed by us, users may create and share playlists. By creating and sharing playlists, you represent and warrant that:

  • You have the right to share the playlist titles, descriptions, and artwork you provide
  • Your playlist content does not infringe on the intellectual property rights of any third party
  • You will not include copyrighted images, logos, or artwork in your playlists without proper authorization

9. Fair Use and Educational Purposes

Psalmix music is provided for personal, non-commercial streaming and listening purposes only. Any use of our content for purposes other than those expressly permitted in our Terms of Service may constitute copyright infringement.

If you wish to use Psalmix content for commercial purposes, public performance, broadcast, or any other use not covered by your subscription, please contact us at hello@psalmix.com (subject: "Licensing Inquiry") to discuss licensing options.

10. International Copyright

Psalmix respects international copyright laws and treaties. Our content is protected under:

  • United States Copyright Law (Title 17, U.S. Code)
  • International copyright treaties and conventions
  • The copyright laws of other countries where our service is available

Unauthorized use, reproduction, or distribution of Psalmix content may violate copyright laws in multiple jurisdictions and may subject infringers to civil and criminal penalties.

11. Reporting Other Violations

If you believe content on Psalmix violates rights other than copyright (such as trademark, privacy, or publicity rights), please contact us at hello@psalmix.com with details of your concern.

11. DMCA and Dispute Resolution

Nothing in Psalmix's arbitration agreement limits your right to submit a DMCA counter-notification or to pursue DMCA-related claims in federal court as provided by 17 U.S.C. § 512. Any dispute regarding your rights under the DMCA is not subject to mandatory arbitration and may be brought in court.
